REGULATIONS OF THE CzasNaButy.pl

Effective as of 31.05.2022


These Regulations set out the rules for the use of the Online Store, in particular, the rules for the conclusion of contracts for the sale of goods in the range of the online store through the online store, the rules for the performance of these contracts and the rules of the complaint procedure. All goods in the assortment of the Online Store are brand new.

I. Definitions


The terms used in the Regulations shall mean:

1.customer - a natural person, a legal person or an organizational unit that is not a legal person, to which special regulations grant legal capacity, who makes an Order from the Store;

2.civil Code - the law of April 23, 1964. (OJ. U. No. 16, pos. 93 as amended.);

4.online store (Store) - Internet service available at www.timenabutes.pl, through which the Customer may, in particular, place Orders;

5.goods - products presented in the Online Store;

6.sales contract - a contract of sale of Goods in the meaning of the Civil Code, concluded between SHELOVET SP. Z O.O. (Entrepreneur) and the Customer, concluded using the Store's website;

7.law on Consumer Rights - Law of May 30, 2014. on consumer rights (Dz.U. of 2014. pos. 827);

8.law on the provision of services by electronic means - the law of July 18, 2002. on the provision of services by electronic means (Dz. U. No. 144, item. 1204 as amended.);

9. RODO - Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016. on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC (General Data Protection Regulation);

10.order - a declaration of will of the Customer, aimed directly at concluding a Sales Agreement, specifying in particular the type and number of Goods.

II. General provisions


1. These Regulations set out the rules for the use of the online store available at www.czasnabuty.pl.

2. These Regulations are the regulations referred to in Art. 8 of the Law on Provision of Electronic Services.

3. Online store, operating at www.czasnavuty.pl, is run by the Entrepreneur SHELOVET SP. Z O.O. 17 Lotników Alianckich Street, 68-100 Żagań (NIP: 5482743706, REGON: 522010632 KRS: 0000971522, Share capital: pLN 120,000)

4. These Regulations specify in particular:
a.) the rules for registering and using an account within the online store;
b.) terms and conditions for making electronic reservations for products available through the online store;
c.) terms and conditions for placing electronic orders within the online store;
d.) the rules for the conclusion of sales contracts using the services provided by the online store.

5. The use of the online store is possible provided that the ICT system used by the Customer meets the following minimum technical requirements:
a.) having a computer or other multimedia device with access to the Internet;
b.) a web browser that supports HTML, CSS, JavaScript standards
c.) javascript enabled
d.) cookies enabled.

6. In accordance with current legislation, SHELOVET SP. Z O.O. reserves the right to limit the provision of services through the online store to persons 18 years of age or older. In such a case, prospective customers will be notified of the above immediately.

7. Customers may access these Terms and Conditions at any time through the link provided on the home page of the www.czasnabuty.pl and download it and make a printout of it. The regulations are also available at the Company's headquarters.

8. Information about goods provided on the store's website, in particular their descriptions, technical and performance parameters and prices, constitute an invitation to conclude a contract, as defined in Art. 71 of the Civil Code.

III. Means of communication


1.The customer has the opportunity to contact the operator of the online store in any of the following ways:

- by phone at the hotline number for landlines and cell phones: 797-510-004 (cost according to. operator's tariff),

- via e-mail to: zamowienia@czasnabuty.pl

- via Chat on the website ( with the possibility to save a copy of the conversation and send it to e-mail)

- through social media channels

IV. Rules of use of the Online Store


1. The condition to start using the Online Store is to register and create a customer account.

2. Registration is done by completing and accepting the form provided on one of the store's pages.

3. The condition for registration is confirmation of familiarization with the provisions of these Regulations and consent to the processing of personal data.

4. SHELOVET SP. Z O.O. may deprive the Customer of the right to use the online store, as well as may restrict its access to part or all of the resources of the online store, with immediate effect, if the Customer violates the provisions of these Regulations, and in particular if the Customer:
a.) provided data during registration in the online store that is untrue, inaccurate or outdated, misleading or violates the rights of third parties,
b.) committed violations of the personal rights of third parties through the online store, in particular the personal rights of other customers of the online store,
c.) will engage in other behavior that will be recognized by SHELOVET SP. Z O.O. for behavior that is inconsistent with applicable law or the general rules of Internet use or that harms the good name of SHELOVET SP. Z O.O.

5. A person who has been deprived of the right to use the online store may not register again without the prior consent of SHELOVET SP. Z O.O., expressed in a separate statement.

6. To ensure the security of the transmission of messages and data in connection with the services provided on the website, the online store takes technical and organizational measures appropriate to the degree of security risk of the services provided, in particular, measures to prevent unauthorized persons from obtaining and modifying personal data transmitted on the Internet.

7. In particular, the customer is obliged to:
a.) not to provide or transmit content that is prohibited by law, such as content that promotes violence, is defamatory or violates the personal rights and other rights of third parties,
b.) to use the Online Store in a manner that does not interfere with its operation, in particular through the use of specific software or devices,
c.) not to take actions such as: sending or posting unsolicited commercial information (spam) within the Internet Store,
d.) use the Online Store in a manner that is not burdensome to other customers and to SHELOVET SP. Z O.O.
e.) use any content posted within the Online Store only for your own personal use,
f.) use of the Online Store in a manner consistent with the provisions of the laws in force on the territory of the Republic of Poland, the provisions of the Regulations, as well as with the general rules of Internet use.

V. The procedure for concluding a sales contract


1. In order to conclude a contract of sale through the online store, one should visit the website www.czasnabuty.pl, make a selection of goods and their colors from the Store's offer, taking further technical actions based on messages displayed to the Customer and information available on the site.

2. The selection of the ordered goods by the customer is made by adding them to the shopping cart.

3. During the ordering process, the Customer has the possibility to modify the entered data and in the selection of Goods. To do so, follow the messages displayed to the customer and the information available on the website.

4. After the customer using the online store has entered all the necessary data, a summary of the placed order will be displayed. The summary of the order placed will include information on:
a.) of the subject of the contract,
b.) of the unit and total price of the ordered products or services, including delivery costs and additional costs (if any),
c.) of the selected payment method,
d.) of the selected delivery method,
e.) of the expected delivery time,

5. In order to send an order, it is necessary to confirm that you have read the Terms and Conditions and agree to the processing of personal data provided in the registration form marked as mandatory and press the "order and pay" button.

6. Sending an order by the Customer constitutes a declaration of intent to conclude with SHELOVET SP. Z O.O. sales contract, in accordance with the content of the Regulations.

7. After the order is placed, the customer receives an email containing the final confirmation of all important elements of the Order.

8. The contract shall be considered concluded upon receipt by the Customer of the e-mail mentioned above.

9. The contract of sale is concluded in the English language, with the content in accordance with the Regulations.

10. Personal data is used only for order processing and, subject to the Customer's separate consent, for the processing of his/her personal data for marketing purposes in order to inform about new products, services and promotions offered by the czasnabuty.pl and will not be shared with others except with authorized entities. The customer has the right to request from the controller access to personal data, the right to rectify, erase or restrict processing, the right to object to processing, as well as the right to data portability; I have the right to lodge a complaint with the DPA when it is substantiated that my personal data is processed by the controller contrary to the General Data Protection Regulation of April 27, 2016. Entrusted personal data shall be stored with rules and safeguards in accordance with the requirements set forth in the applicable laws of the Republic of Poland, including:
  • Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016. on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC (General Data Protection Regulation);
  • Act of 29.08.1997. on the protection of personal data (Dz. U. 2016 pos.922, as amended. zm.);
  • Act of 18.07.2002. on the provision of services by electronic means (Dz. U. No. 144, item. 1204 with subsequent. zm.);

    VI. Delivery


    1. Delivery of Goods is made to the address indicated by the Customer when placing the order.

    2. Deliveries of ordered goods are made via courier service and delivered to Parcel Machines.

    Delivery costs are listed on the website: SUPPLY COSTS. In addition, the date and cost of delivery will be indicated at the time of ordering.

    Recording, securing, making available and confirming to the customer the important provisions of the contract of sale of goods is done by sending the confirmation to the customer at the e-mail address provided and by attaching to the parcel containing the goods a printout of the confirmation of sale, receipt or VAT invoice.

    VII. Prices and payment methods


    1. Prices of goods are given in EUR and include all components, including the current rate of VAT.

    2. The customer has the option to pay the price:
    a.) by bank transfer to the bank account number40105010701000009081637002,
    b.) in person in cash when picking up the goods from the courier company employee,
    c.) by payment in PayU, Przelewy24 and Imoje system
    d.) payment by credit card (Visa, Mastercard) - payments are supported by systems: PayU,Przelewy24, Imoje
    The credit card is charged before the goods are shipped.
    e.) Twisto payment in Imoje system ( deferred payment for 21 days )

    VIII. The right to withdraw from the contract


    1. The buyer has the right to withdraw from the concluded contract in writing without giving any reason within within 30 days, from the date of conclusion of the contract under the Law of May 30, 2014. (OJ.U. 2014 r. pos. 827 as amended.) In the case of written withdrawal from the contract, the customer is obliged to return the goods within 30 days. The entitlement referred to above also applies to an individual entering into a contract directly related to his or her business activity, when the content of that contract shows that it does not have a professional character for that person, arising in particular from the the subject of his/her business activity, made available on the basis of the provisions of the Central Registration and Information on Economic Activity.

    To exercise your right of withdrawal, you must inform the store of your decision by a unilateral statement (for example, by a letter sent by regular mail to SHELOVET SP. Z O.O., 17 Lotników Alianckich Street, 68-100 Żagań or by e-mail to: zamowienia@czasnabuty.pl).

    The store provides a withdrawal form, but the use of it is not mandatory.

    You can also fill out and submit a withdrawal form or any other unambiguous statement electronically on our website (www.czasnabuty.pl). If you use this option, we will immediately send you an acknowledgement of receipt of the withdrawal information by e-mail.

    In order to comply with the withdrawal period, it is sufficient for you to send information concerning the exercise of your right of withdrawal before the expiry of the withdrawal period.

    2.in the event of withdrawal from this contract, we will return to you all payments received from you, including the costs of delivering the items (except for the additional costs resulting from the delivery method chosen by you other than the cheapest ordinary delivery method offered by the Store). We will return the payments immediately, and in any case no later than 14 days from the day we are informed of your decision to withdraw from the contract. We will refund the payment using the same means of payment that you used in the original transaction, unless you have expressly agreed otherwise. In any case, you will not incur any fees in connection with this return. 

    Please return the Goods immediately to the following address: SHELOVET SP. Z O.O., ul. Lotników Alianckich 17 68-100 Żagań and in any case no later than 30 days from the day on which you informed us of your withdrawal from the contract. The deadline is met if you send back the item before the expiration of the 30-day period. You will also have to bear the direct costs of returning the goods.

    3. By withdrawing from the contract, you consent to the processing of your personal data pursuant to Art. 6(1)(c) of the General Data Protection Regulation of April 27, 2016., in terms of: name, surname, address, telephone number, bank account number by SHELOVET SP. Z O.O. with its registered office at 17 Lotników Alianckich Street 68-100 Żagań; for the purpose of refunding the amount due for the purchased goods as a result of withdrawal from the contract. You know that personal data will be stored for a period of 5 years and that you have the right to request from the controller access to personal data, the right to rectify, erase or restrict processing, the right to object to processing, and the right to data portability; I have the right to lodge a complaint with the DPA when it is justified that personal data is processed by the controller in violation of the General Data Protection Regulation of April 27, 2016. You are aware that the provision of personal data is required for reimbursement and payment of claims. The consequence of failing to provide the above. personal data is the impossibility of reimbursement.

    VIX. Complaints about Goods


    1. SHELOVET SP. Z O.O. as a seller is liable to the customer under the Act of 4.11.2022 on amendments to the Law on Consumer Rights, i.e. chapter 5a art. 43a (This law implements Directive 2011/83/EU of the European Parliament and of the Council of October 25, 2011.)

    2. Complaints under warranty should be sent to the address of the store: 17 Allied Lotników Alianckich Street 68-100 Żagań with the note "Complaint" or to the email address: returns@czasnabuty.en. SHELOVET SP. Z O.O. undertakes to process each complaint within 14 days. If the Consumer is not informed by 14 days about the manner of of the complaint is considered to be resolved to the advantage of the Consumer. Complaints can also be made electronically on our website www.czasnabuty.pl after logging in to the Customer Panel

    3. The seller is liable for the lack of conformity of the goods with the contract existing at the time of delivery and revealed within two years from that time.

    4. If the goods are inconsistent with the contract, the consumer may demand repair or replacement, and only in the next place may demand a price reduction, or withdraw from the contract.

    5.The consumer will be able to make a statement to the seller to reduce the price or withdraw from the contract if :
    a.The seller refused both to replace and repair the goods on the grounds that either both were impossible or prohibitively expensive;
    b.The seller did not remove the nonconformity of the goods in accordance with the provisions on the implementation of repair or replacement of goods (e.g., did not remove the nonconformity within a reasonable time);
    c.The seller's attempt to remedy the nonconformity failed (e.g., when the seller delivered defective goods as part of the exchange, or failed to remedy the defect in the goods despite attempts to repair them)
    d.The lack of conformity of the goods with the contract is so significant that it justifies either an immediate price reduction or cancellation of the contract;

    6.The consumer shall make the goods subject to repair or replacement available to the Seller. The Seller collects the goods from the Consumer at his own expense.

    X. Newsletter


    1. Service: SMS Newsletter and E-mail Newsletter is provided by: SHELOVET SP. Z O.O. 17 Lotników Alianckich Street 68-100 Żagań, (NIP: 5482743706, REGON: 522010632).

    2. Under the E-mail Newsletter service, information in the form of an electronic letter (e-mail), hereinafter referred to as "Newsletter", is sent by e-mail to the electronic mail address (e-mail address) provided by the User. Newsletter service is provided free of charge for an indefinite period of time. Newsletter contains information about the offer of products offered by the online store and current promotions.

    2.1. by subscribing to the E-mail Newsletter, the user agrees to the processing of his/her personal data in the following scope: e-mail address for the purpose of sending the E-mail Newsletter by SHELOVET SP. Z O.O. with its seat in 68-100 Żagań, ul.Lotników Alianckich 17. He/she knows that his/her personal data will be kept until he/she revokes his/her consent to processing for marketing purposes. The consent granted may be withdrawn at any time by sending an email to: rodo@czasnabuty.pl. Knows that he/she has the right to request access to personal data from the controller, the right to rectify, erase or restrict processing, the right to object to processing, and the right to data portability; has the right to lodge a complaint with the DPA when it is substantiated that his/her personal data is being processed by the controller in violation of the General Data Protection Regulation of April 27, 2016. Is aware that providing personal data is voluntary, however, failure to provide data to the extent required by the administrator makes it impossible to use the E-mail Newsletter service.

    3. Within the SMS Newsletter service, information in the form of a text message, hereinafter referred to as "SMS Newsletter", is sent via a cell phone to the phone number provided by the User. SMS Newsletter service is provided free of charge for an indefinite period of time. The newsletter contains information about the offer of products offered by the online store and current promotions, as well as links to the website maintained under the domain: www.czasnabuty.pl.

    3.1. by signing up for the SMS Newsletter, the user agrees to the processing of his/her personal data in the scope of: phone number for the purpose of sending the SMS Newsletter by SHELOVET SP. Z O.O. headquartered in 68-100 Żagań, 17 Lotników Alianckich Street. He/she knows that his/her personal data will be kept until he/she revokes his/her consent to processing for marketing purposes. The consent granted may be withdrawn at any time by sending an email to: rodo@czasnabuty.pl, in which case his phone number will be removed from the ww. bases. Knows that he/she has the right to request access to personal data from the controller, the right to rectify, erase or restrict processing, the right to object to processing, and the right to data portability; has the right to lodge a complaint with the DPA when it is substantiated that his/her personal data is being processed by the controller in violation of the General Data Protection Regulation of April 27, 2016. Is aware that the provision of personal data is voluntary, however, failure to provide data in the scope required by the administrator makes it impossible to use the SMS Newsletter service.

    4. Use of the E-mail Newsletter and SMS Newsletter service is subject to the User having a computer or other multimedia device with access to the Internet, and to the User having an active electronic mail (e-mail) account and/or cell phone.

    XI. Complaints regarding the provision of electronic services


    1.sHELOVET SP. Z O.O.takes measures to ensure fully correct operation of the store, to the extent that results from current technical knowledge, and undertakes to remove within a reasonable time any irregularities reported by customers.

    2. Irregularities related to the functioning of the Store, the Customer may report in writing to the address: SHELOVET SP. Z O.O. ul.Lotników Alianckich 17 68-100 Żagań or by email at rodo@czasnabuty.pl or by using the contact form.

    3. In a complaint, the Customer should provide his/her name, mailing address, type and date of occurrence of irregularities related to the functioning of the Store.

    4.sHELOVET SP. Z O.O. undertakes to consider each complaint within 14 days, and if this is not possible, to inform the customer within this period when the complaint will be considered.

    XII. Store and product reviews.


    1.In order to ensure the best possible quality of services, we use the services of eKomi ( Trusted.pl) , through which customers can express their opinions about our store and purchased products.

    2. Reviews are provided only by transactional customers who are willing to share their shopping experience. Each customer receives an invitation to give feedback in the form of an individual and one-time link that relates to the order and the products or services purchased.

    3. The service publishes both positive and negative reviews, from transactional consumers. The reviews are accepted in accordance with Ekomi's regulations, which you can find here.

    4.Average rating of the store presented through eKomi widgets ( Trusted.pl ) is calculated on the basis of all verified ratings for the last 12 months. The rating scale is 1-5 stars.

    XIII. Personal information and privacy policy. Information obligations.


    1. The personal data provided by the customer during the registration or ordering process is processed by SHELOVET SP. Z O.O. with its registered seat at ul. Lotników Alianckich 17 68-100 Żagań; entered in the Register of Entrepreneurs of the National Court Register by the District Court in Bielsko-Biała VIII Economic Department of the National Court Register under the KRS number 0000556090, having tax identification number NIP: 5482743706, REGON number: 522010632, which is the administrator of personal data.

    2. A necessary part of the procedure for creating an account and placing an order is for the Customer to provide his/her personal data, marked as mandatory, and to give his/her consent to the processing of his/her personal data provided during registration. Provision of personal data marked as mandatory is voluntary, however, it is necessary for the purpose of registration and order placement, order processing and service. Provision of personal data not marked as obligatory is voluntary.

    3. If the Customer has given separate consent for the service provided electronically, the subject of which is the free delivery of newsletters, the obtained electronic mail address (e-mail address) and telephone number is added to the mailing list and is used for marketing purposes to send the Customer commercial information electronically in the form of a Newsletter (E-mail Newsletter and/or SMS Newsletter), in accordance with point. IX of these Regulations.

    4. Consent for the processing of personal data is given by checking the appropriate box on the form by the customer.

    5. Collected personal data are not shared with third parties, with the exception of the transfer of data to entities participating in the execution of the order in order to deliver the ordered goods to the Customer, i.e. DPD POLAND Sp. featuring.o. based in Warsaw, Poczta Polska S.A. or InPost Paczkomaty limited liability company based in Krakow. If payment for the ordered goods is made in advance or at the InPost Parcel Machine, the data are also transmitted to the entity through which the transaction is settled. The scope of data provided is limited to the necessary minimum, in accordance with the principle of minimization of personal data.

    6. The customer has the right to request from the controller access to personal data, the right to rectify, delete or restrict processing, the right to object to processing, and the right to data portability. The customer also has the right to lodge a complaint with the DPA when it is substantiated that their personal data is being processed by the controller in violation of the General Data Protection Regulation of April 27, 2016., referred to as "RODO"; For this purpose, he should contact the Company at the following address: SHELOVET SP. Z O.O. 17 Lotników Alianckich Street 68-100 Żagań or rodo@czasnabuty.pl.

    7. The customer has the right to obtain information on whether and to what extent his/her personal data are processed, as well as information on the purpose and scope of the processing of his/her personal data. For this purpose, he should contact the Company in the manner indicated in section 6 above.

    8. The Company, as the controller of personal data, may entrust another entity, by means of a written agreement, with the processing of personal data, subject to the provisions of Art. 28 RODO;

    9. The company uses cookies. For detailed provisions on data protection and privacy policy, please refer to the Policy on the Use of Cookies, which is available on the store's website under the "Cookie Policy" tab at https://www.czasnabuty.pl/policy-cookies-cterms-pol-47.html.

    XIV. Reservations


    The entirety of the presented website is the property of Shelovet sp. z.o.o. based in Żagań and is a work within the meaning of the Act of February 4, 1994. on Copyright and Related Rights (Dz. U. No. 90, pos. 631). No part of it (including descriptions, content, photos, illustrations) may be distributed or copied by any means (electronic, mechanical or otherwise) in whole or in part without written permission from Shelovet sp. z o.o. based in Żagań. The use of a work or part of it without the author's consent constitutes an infringement of author's economic rights, which entails the need to protect them through legal proceedings. We stipulate that any violation will result in referral to legal proceedings to protect the author's rights.

    XV. Final provisions


    1. Settlement of possible disputes arising between SHELOVET SP. Z O.O.and a customer who is a consumer within the meaning of Art. 221 of the Civil Code, shall be submitted to the competent courts in accordance with the provisions of the relevant provisions of the Code of Civil Procedure.

    2. The consumer also has the opportunity to use out-of-court means of handling complaints and claims, including:
    a) The consumer is entitled to apply to the permanent amicable consumer court operating at the Trade Inspection with a request for settlement of a dispute arising from the concluded sales contract.
    b) The Consumer is entitled to apply to the Provincial Inspector of Trade Inspection with a request to initiate mediation proceedings for an amicable settlement of the dispute between the Consumer and the Seller.
    (c) A consumer may obtain free assistance at the office of the district (city) consumer ombudsman or a social organization whose tasks include consumer protection ( m.in. Federation of Consumers, Association of Polish Consumers).

    4. The consumer may use out-of-court ways of dealing with complaints and claims. Wanting to take advantage of the possibility of amicable resolution of online shopping disputes, the consumer can file his complaint, for example, through the EU online ODR platform, available at: http://ec.europe.eu/consumers/odr/.

    5. Settlement of possible disputes arising between SHELOVET SP. Z O.O.and a customer who is not a consumer within the meaning of Art. 221 of the Civil Code, shall be submitted to the court having jurisdiction over the seat of SHELOVET SP. Z O.O.

    6. In matters not covered by these Regulations, the provisions of the Civil Code, the provisions of the Act on Providing Services by Electronic Means and other relevant provisions of Polish law shall apply.
